1. Acceptance of Terms

By accessing or using the Camisual platform (“Service”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Camisual is a web-based graphic design platform that provides tools for creating, editing, and sharing visual content, including but not limited to: a canvas editor, layering tools, brush tools, shape tools, text tools, AI-powered image generation, and background removal. We offer both free and paid subscription plans.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. By creating an account, you represent and warrant that you meet this requirement.

4. Subscriptions and Payments

Camisual offers a free plan and paid subscription plans. By subscribing to a paid plan, you agree to the following:

• Subscription fees are charged in advance on a monthly or annual basis
• All payments are processed securely by Stripe
• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings
• Refunds are provided at our discretion and only within 14 days of payment if the service was not used
• We reserve the right to modify pricing with 30 days' prior notice

5. Free Trial

We may offer a free trial of paid features. At the end of the trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial ends. We reserve the right to modify or discontinue free trial offers at any time.

6. User Content

You retain all rights to the content you create, upload, or share using our Service (“User Content”). By using the Service, you grant us a limited, non-exclusive, royalty-free, worldwide license to host, store, and display your User Content solely to provide the Service to you.

You represent and warrant that:

• You own or have the necessary rights to the content you upload
• Your content does not infringe the intellectual property rights of any third party
• Your content does not violate any applicable laws or regulations

7. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe the intellectual property rights of others
• Upload or transmit malware, viruses, or other malicious code
• Harass, abuse, or harm another person
• Create or distribute content that is hateful, obscene, or defamatory
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated means (bots, scrapers) to access our Service without permission
• Reverse engineer, decompile, or disassemble any part of our Service
• Resell or redistribute the Service without our written consent

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Camisual and its licensors. Our trademarks, logos, and service marks may not be used in connection with any product or service without our prior written consent. Nothing in these Terms transfers any intellectual property rights to you.

9. AI-Generated Content

The Service includes AI-powered features for generating images and other content. You acknowledge that:

• AI outputs are generated automatically and may not always be accurate or appropriate
• You are responsible for reviewing and verifying AI-generated content before use
• AI generation credits are consumed per use and do not roll over between billing periods unless stated otherwise
• We reserve the right to modify AI models, features, and credit costs at any time

10. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Camisual and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

12. Indemnification

You agree to defend, indemnify, and hold harmless Camisual and its licensors, service providers, employees, agents, officers, and directors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

13. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason. Upon termination, your right to use the Service will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the competent courts of the jurisdiction where Camisual operates.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
